Avoid FRS for drainage issues

We have ongoing problems with FRS Kansas City who were hired in December 2023 to install a basement waterproofing system During the installation process the company has failed to complete the basic works in the contract at the home despite hundreds of hours meetings with them emails and text correspondence chasing them to do so There are several scope items from the original contract which have not been completed There were also areas where the company intentionally faked doing work on the premises which they were paid for and only came clean after a major flood which caused tens of thousands in damages Since the system was installed the house has flooded 12 times causing thousands in damages and delaying the construction by several months As of late July the vendor had promised to complete all the works in the contract and reimburse us for all the flood damage Unfortunately FRS have not kept their word and in October after submitting all the invoices FRS formally refused to reimburse us for the damages FRS have also refused to finish the project and have now said they want us to accept them voiding the lifetime warranty on the project in exchange for payment of about 10 of the cost of the damages that occurred when their waterproofing system failed twelve times since installation It is important to note that we are still getting water ingress under the basement stair At this point we have a failing waterproofing system that is not fully installed and a basement which has been finished above it There is in excess of 200 000 of new construction on top of their system which will need to be removed if their system needs to be replaced by a reputable contractor As an architect I would never hire a waterproofing contractor for this type of work without a lifetime warranty because the risks associated with water ingress are so high I have hundreds of pages of emails texts and photographs I would be happy to share if you need more details
