What s the point

I had hoped that POPLA would independently judge the parking charge I received I do not now feel that this is the case and to ask them to help cost me a further 40

Popla don t even consider your evidence Waste of time

As others have rightly said do NOT bother with popla unless you are pretty sure you have a watertight case with hard evidence against the carpark operator I suspect that in 80 of cases popla just sides with the carpark operator by default and often as in my case their assessor will not even bother to take the time to look at the evidence submitted I had photos clearly showing that the carpark conditions notice at entry was obscured by another sign and not visible so had no idea it wasn t a free carpark Popla anyway sided with the operator which is ludicrous To be fair they are affected by the BPA which are a crooked organisation themselves Will be using citizens advice instead and if the carpark operator want to pursue their greed for money then they can fight me in small claims court I m confident they will lose

Thankyou for your response I am glad Popla is now prepared to review our case I will keep everyone updated about our further appeal As stated before a private car parking ticket is only an invoice Its totally different to a public road or council owned car parking PCN The private car parking company has to take you to court on the grounds you breached their unwritten contract which costs more money than it is worth We have informed Smart Parking of this invited them to take us to court and to date have received no reply Do not let the private car parking companies bluff you into paying Stand firm and you will be successful

Wanted some impartial assistance

Wanted some impartial assistance regarding a failed appeal to the despicable Minster Baywatch Don t remember receiving a PCN appeal decision unable to find a 10 digit code to submit a case to POPLA I didn t realise they and POPLA were in bed together I didn t even park there was no car park This was a street off a very busy thoroughfare in York Previously these were resident permit or ten minute waiting spaces still shown as such on Google maps My son was 4 weeks post surgery for a compound tib fib fracture and on crutches I literally alighted him safely for the dentist and went to Tesco and returned and picked him up 50 minutes later The PCN even has the car facing in two directions Minster Baywatch were advised that if they could show continuous footage of my vehicle in their street parking bay between 10 10 and 10 55 am I would willingly pay I know they can t they are chancers The people represented by this company are nothing but 21st century highwaymen and I can t therefore see them upholding any appeal made through their website

Fined twice

My appeal was not upheld The email came this morning and I used the link provided to contact parking eye The fine was 60 but because I appealed it has risen to 100 In effect I have been fined twice once for an unavoidable parking infringement and a second fine for daring to appeal Popla stated when they received my appeal that they would make judgement in 3 - 4 week 23rd March - 18th May is 8 weeks

Powerless

They do seem to take time to carefully consider the evidence and make informed decisions However as many other reviews state the company is more like an observer with very limited authority Parking Agents are given free rein to overcharge as they wish they write the cheque and they cash it

Need a Company to help us victims

It is a shame that we do not have an appeal system to actually help reduce the greed of these scrupulous parking companies I wouldn t mind if my 70 fine went to the NHS but this was clearly recouping the money from the other cars parking for free outside A E as their barrier was broken The hospital states that all patients have 15 minutes free period but they didn t allow an adequate amount of time before rushing to slap my electric car in an electric car bay with a fine when I parked for less than 15 minutes outside A E I personally could not make any sense of their contradictory contracts in two different areas so had decided to move my vehicle

Not unbiased

The decision timing on operators is unlimited yet we have to submit evidence within a timeframe By the time they have drag it to make a decision you are forced to pay a higher fine which is unfair There is no differentiation between real users and those who broke the rules As a genuine user who did not abuse the car park I found this totally unacceptable Edited to reaponse - while I understand POPLA don t set the fine amount but your inaction or delay to make a decision bias favour towards parking company contributes to the end result Perhaps you should consider how impartial you really are
